1. Services Overview

We provide custom 3D scanning, digital modeling, and artistic figure portrait creation services based on customer-submitted images, scans, and reference materials.

All products are custom-made and commissioned, tailored specifically to each customer.

 

2. Eligibility & Age Requirements

• You must be 18 years of age or older to place orders or book services.

• For individuals under 18, a parent or legal guardian must sign a consent form and be present during in-studio scanning sessions.

• We reserve the right to refuse service to any individual who does not meet these requirements.

3. Customer Responsibilities & Image Rights

By submitting images, scans, or participating in scanning sessions, you agree to the following:

 

A. Ownership of Produced Scans & Images

All scans, images, 3D models, and derivative works produced by the Company during the creation process become the exclusive property of [Your Business Name], including but not limited to:

• 3D body scans

• Photogrammetry data

• Processed meshes

• Texture maps

• Derived reference images

 

B. Facial Image Usage Limitation

• Facial images, facial scans, and identifiable facial data will never be used for any purpose other than producing your commissioned sculpture or 3D likeness.

• Facial data is never reused, licensed, sold, shared, or repurposed for any secondary application.

• Facial scan data is deleted after project completion, unless the customer explicitly requests retention.

 

C. Promotional & Portfolio Rights

You grant [Your Business Name] a perpetual, worldwide, royalty-free license to:

• Photograph, render, display, and publish the final sculpture, printed model, or digital likeness

• Use such materials for marketing, promotional content, portfolio display, website, social media, and advertising purposes

This license excludes facial scan data and raw identifiable images, which are never publicly displayed without explicit consent.

 

D. Clothing Models & Non-Unique Asset Rights

You acknowledge and agree that:

• We retain the full rights to reuse, modify, and redistribute clothing scans, clothing models, and garment textures that are not uniquely identifiable to you.

• Clothing assets may be retained for:

  • Generic modeling libraries

  • Internal production workflows

  • Commercial asset generation

• Customers may opt out of clothing scan retention during sign-in or onboarding.

 

E. Promotional, Portfolio & Resale Rights (With Customer Approval)

You grant [Your Business Name] a perpetual, worldwide, royalty-free license to:

• Photograph, render, display, and publish the final sculpture, printed model, or digital likeness

• Use such materials for marketing, promotional content, portfolio display, website, social media, and advertising purposes

Additionally, with explicit written customer approval, the Company may:

• Produce additional copies of the final sculpture

• Offer the sculpture for retail sale in our online or physical store

This resale permission:

• Requires explicit customer authorization

• Does not include reuse of facial scan data or raw identifiable imagery

• May be revoked in writing prior to resale production

 

F. Legal Rights to Submitted Materials

You confirm that:

• You own or have full legal rights to all materials submitted.

• Submitted content does not infringe on intellectual property, privacy, or publicity rights.

• You grant the Company full rights to process and modify submitted materials for production purposes.

 

4. Orders, Pricing & Payments

• All prices are listed in U.S. Dollars (USD).

• Payments are processed through PayPal and Shopify.

• Orders are not considered confirmed until payment is received.

• We reserve the right to refuse or cancel any order.

 

5. Custom Work & Artistic Interpretation

All services involve artistic interpretation and technical processing.

Minor differences in appearance, texture, proportions, and color are expected and are not considered defects.

 

6. Revisions & Approval Process

Each project includes [X] revision rounds unless otherwise stated.

Additional revisions or redesign requests may incur extra fees.

 

7. Refund, Cancellation & Chargebacks

Because all products are custom-made:

• Before work begins: Full refund possible

• After work begins: No refunds

• After production starts: No refunds

Unauthorized chargebacks may result in service termination and legal recovery.

 

8. Delivery Timelines

All delivery dates are estimates. We are not responsible for delays beyond our control.

 

9. Intellectual Property Rights

All internal workflows, sculpting techniques, production methods, and digital assets remain the exclusive intellectual property of [Your Business Name].

Customers receive a personal-use license only, unless otherwise agreed in writing.

 

10. Prohibited Use

You may not use our services to produce illegal, infringing, abusive, or unlawful content.
